‍

Welcome to Decker Glass. These Terms and Conditions (“Terms”) apply to your use of deckerglass.com (the “Website”) and to our text messaging program (the “SMS Program”). By using the Website or enrolling in the SMS Program, you agree to these Terms. If you do not agree, please do not use the Website or enroll. In these Terms, “Decker Glass,” “we,” “us,” and “our” refer to Decker Glass, and “you” refers to the person using the Website or SMS Program.

These Terms do not replace any written quote, estimate, or service agreement you have with us for products or services.

1. Use of Our Website

You may use the Website for lawful purposes only. You agree not to misuse it, interfere with its operation, attempt unauthorized access, or submit false or misleading information.

Privacy. Your use of the Website is also subject to our Privacy Policy, which explains what information we collect and how we use it. This includes our use of cookies.

‍ Accounts. If you create an account, you must give accurate information and keep it current. You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly at [email] if you suspect unauthorized use. We may suspend or close accounts as described in Section 6.]

2. SMS Messaging Terms & Compliance

Program description. The SMS Program lets you receive text messages from Decker Glass at the mobile number you provide. Program name: [Decker Glass Text Messaging].

Two separate opt-ins. On our Contact Us form you may choose either or both of the following. Each is optional and independent.

  • Appointment and meeting messages (non-marketing): texts about meetings and appointments with Decker Glass, such as scheduling, confirmations, and reminders.
  • Marketing and promotional messages: texts about special offers, discounts, and new product updates.

Eligibility. You must be at least 18 years old to enroll in the SMS Program.

Explicit opt-in. We send text messages only after you have explicitly opted in by checking the relevant box on our Contact Us form. We keep timestamped records of each opt-in. We do not send promotional text messages without your specific consent. Consent to receive texts is not a condition of purchasing any goods or services.

Message frequency. Message frequency varies.

Costs. Message and data rates may apply. Your mobile carrier sets these rates, and we do not charge for the messages.

Opt-out (STOP). You can cancel at any time by replying STOP to any message. You will receive one final confirmation message, and no further messages will be sent unless you opt in again. If you only want to stop promotional texts, tell us at [phone] or [email].

Re-enrolling. To start receiving messages again after opting out, check the relevant box again on our Contact Us form [or reply START to the number you received messages from]. [Include the START option only if your texting platform supports it.]

Help. Reply HELP to any message for assistance, or contact us at [phone] or [email]. [Customer support is available [days and hours].]

Carriers. Wireless carriers are not liable for delayed or undelivered messages.

Phone number changes. If you change or give up your mobile number, please tell us so we can update our records.

Compliance. We comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and other applicable laws and carrier requirements.

Your data. See our Privacy Policy for how we handle your information. We do not share mobile phone numbers or text message opt-in and consent information with third parties or affiliates for marketing or promotional purposes, except the service providers that deliver our messages on our behalf.

3. Intellectual Property

Unless otherwise stated, Decker Glass and its licensors own the intellectual property in all Website content, including text, images, logos, and design. You may view the Website for personal, non-commercial use. You may not republish, sell, rent, sub-license, reproduce, duplicate, copy, or redistribute Website content without our written permission.

4. Links

You may link to our home page if the link is not deceptive, does not falsely imply sponsorship or endorsement by us, and fits the context of your site. We may ask you to remove a link at any time. You may not use our logo or artwork in a link without a written license, and you may not frame our pages in a way that alters their appearance without our permission. Our Website may link to third-party sites. We do not control them and are not responsible for their content or privacy practices.

5. Disclaimer and Limitation of Liability

We try to keep the Website accurate and available, but we do not warrant that its content is complete, accurate, or current, or that it will be uninterrupted or error-free. To the maximum extent permitted by law, the Website is provided “as is,” and we exclude all representations and warranties about it. To the maximum extent permitted by law, Decker Glass is not liable for any indirect, incidental, or consequential damages arising from your use of the Website or SMS Program. 6. Termination and Suspension

We may suspend or end your access to the Website or SMS Program at any time, without notice, if we believe you have violated these Terms, misused the Website or messaging program, or engaged in unlawful activity. You may stop using the Website at any time and opt out of text messages by replying STOP.

7. Governing Law and Dispute Resolution

Governing law. These Terms are governed by the laws of the State of [Wyoming], without regard to conflict-of-law rules.

Informal resolution first. If you have a dispute with us, please contact us first at [email] and give us 30 days to try to resolve it.

Binding arbitration. [If we cannot resolve a dispute informally, either of us may require that it be resolved by binding arbitration administered by [the American Arbitration Association] under its rules, with the arbitration held in [Casper, Wyoming] or remotely. You and Decker Glass agree to resolve disputes only on an individual basis and not as a class, collective, or representative action. Either of us may instead bring an individual claim in small claims court. You may opt out of this arbitration provision within 30 days of first agreeing to these Terms by emailing [email]. Arbitration replaces the right to go to court and have a jury trial.]

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.

8. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. If we make material changes, including to the SMS Program, we will update the date above and may notify you by email or a notice on the Website. Your continued use after changes take effect means you accept them.
